Supreme Court Justice V. Mohana recused herself on Friday from hearing the anticipatory bail plea filed by DMK V. Senthil Balaji. The case concerns a corruption investigation into alleged irregularities within the Tamil Nadu State Marketing Corporation (TASMAC).
Following the recusal, Chief Justice Surya Kant announced that a bench consisting of himself and Justice Joymalya Bagchi will hear the matter at 1 p.m. due to the urgency of the request. The Supreme Court agreed to review the case after the Madras High Court previously dismissed Balaji's petition for pre-arrest bail.
Counsel for Balaji argued that the FIR, which alleges a systematic kickback scheme and overcharging at TASMAC retail shops, is politically motivated. The defense maintains that the leader is not a flight risk and that custodial interrogation is unnecessary regarding the alleged incidents occurring between 2021 and 2025.
