US Refunds $10 Billion Excess Duties to Indian Exporters

The United States government is in the process of refunding over $10 billion (approximately Rs. 95,000 crore) in excess customs duties to Indian exporters. These duties were initially imposed under the International Emergency Economic Powers Act (IEEPA), targeting countries with significant trade surpluses with the US.The tariff measures began in April last year. On August 7, a 25% reciprocal customs duty was levied on key Indian export products. This was followed by an additional 25% on August 27, citing Russian oil imports, leading to Indian exporters facing up to a 50% increase in customs duty.However, the US Supreme Court, after hearing challenges against these tariffs, declared them unconstitutional on February 20. Following this ruling, the US government is now taking steps to return the collected amounts. The US Customs and Border Protection (CBP) has issued detailed administrative guidelines for the refund process.Industry experts welcome this development, noting that exporters from sectors such as textiles, engineering goods, chemical products, and various manufacturing industries will significantly benefit. Initially, there was uncertainty regarding how Indian banks without direct correspondent banking relationships in the US would receive these funds. The Reserve Bank of India (RBI) has clarified that banks with branches or agency banking facilities in the US can open collection accounts to facilitate these payments, thereby resolving major banking hurdles.
